People who were born outside Australia to an Australian Citizen at the time of their birth may be eligible for Australian citizenship by descent.
Some people have acquired Australian citizenship by operation of law and may want evidence that they are a citizen. In this case, they would need to apply for and receive a citizenship certificate.
There are a few other circumstances when people may be eligible for Australian citizenship. These are:
  • You are an Australian Permanent Resident a Child 15 years old or younger, and applying on your own.
  • You were born to a former Australian citizen.
  • You were adopted as a Child outside Australia by an Australian citizen.
  • You were born in Papua before its independence in 1975.
  • You were born in Australia and are stateless.

A Resident Return Visa subclass 155/157 allows you to maintain your permanent residence, travel overseas and return to Australia at the end of your trip. The Resident Return Visa can be granted for up to 5 years, provided the residence requirements are met. A shorter, for up to 12 months, Resident Return Visa can also be granted when the residence requirement cannot be met. A legal submission explaining your situation, as well as evidence of substantial ties to Australia, will be required for the grant of the shorter Resident Return Visa.
